Pursuant to the Article 23, line 3 of the Law on electricity ("Official Gazette of the Republic of Srpska" number 66/02, 29/03, 86/03 and 111/04), Article 10, line 3 ofo the Statute of the Regulatory Commission for electricity of Republic of Srpska ("Official Gazette of Republic of Srpska" number 41/04), Article 37, paragraph 1, point 3 of the Procedural rules of the Regulatory Commission for electricity of Republic of Srpska ("Official Gazette of Republic of Srpska" number 96/04), Article 54 of the Rule book on tariff methodology and tariff proceeding ("Official Gazette of Republic of Srpska" number 71/05), in the first tariff proceeding conducted on the initiative of the Regulatory Commission for electricity of Republic of Srpska, following the application of the electric distribution companies in Republic of Sprska for approval of tariffs for the distribution systems' users, the Regulatory Commission for electricity of Republic of Srpska, in its regular 28th session which was held on 22nd March 2006, made
DECISION
on determination of tariff rates for the distribution system users

This Decision was made by the Regulatory Commission for electricity of Republic of Srpska (hereinafter: REERS) to determine the price of using electric power network for the distribution system users, expressed through the tariff rates.

III
It is determined the capacity charge for the first tariff period for the following groups of buyers from the consumption category of 0,4 kV of voltage which category is not measured:
Other consumption with the one-tariff meter: 5 kW
Other consumption with the two-tariff meter: 5 kW
Households with the one-tariff meter: 3,3 kW
Households with the two-tariff meter: 5,2 kW
IV
Tariff rates in high season HS are applied in the period from 1 October to 31 March.
Tariff rates in low season LS are applied in the period from 1 April to 30 September.
High daily tariff rates HT are applied in the period from 06,00 - 22,00 hours for winter time and 07,00 -23,00 hours for summer time.
Low daily tariff rates LT are applied in the period from 22,00 - 06,00 hours for winter time and 23,00 - 07,00 for summer time and continuously from Friday at 22,00 (23,00) to Monday at 06,00 (07,00) hours.

Excessively taken reactive energy is calculated in the period of application of high daily tariff rates.
VI
Tariff rates for the distribution systems' users are applied for calculation and invoicing of the service for electric power network usage to eligible buyers whose structures are connected to the distribution network to compensate costs of the distribution network usage, transferred costs of the transmission network usage and transferred costs of provision of the ancillary services to the companies - distribution licensees.
VII
Electric power companies, distribution licensees are obliged to publish tariff rates for distribution system users and relevant provisions of this Decision and make them available for all users.
VIII
This Decision becomes effective the day it is made and it is published in the Official Gazette of Republic of Sprska and it is applied as of 01 April 2006.
Rationale
Tariff rates for the distribution systems' users were determined based on costs of the electric energy distribution, pursuant to REERS Decision on determination of the price for distribution and supply of electricity in Republic of Srpska number 01-1437-4/06 dated 22 March 2006 and accompanying allocated part of the costs which are transferred to the distribution companies based on taking of electricity from the transmission network, pursuant to the Decision of the State Regulatory Commission for electricity in BiH (hereinafter: SERC) and costs of ancillary services calculated pursuant to the tariff methodology of SERC.
Costs of the distribution network, including costs of losses of electricity in the distribution network, allocated on the tariff elements and categories of consumption, were determined in the following amounts:

Costs of the transmission network, costs of operation of the Independent System Operator, costs of ancillary services and costs of transmission losses, i.e. accompanying price taken from SERC allocated on the categories of consumption per voltage levels, along with the prices of usage of distribution network from the paragraph 2 of this Rationale, make the price of usage of the electric power network (network cost) for buyers of electricity in Republic of Srpska.
Participation of the price of usage of the transmission network for the distribution system users was determined based on the unit price of 0,0098 KM/kWh of taken active electricity from the transmission network, determined by Decision of SERC number 04-28-248-37/05 dated 21 March 2006.
Participation of the price for services of the Independent System Operator for the distribution system users was determined based on the unit price of 0,000343 KM/kWh of the taken active electricity from the transmission network, determined by the Decision of SERC number 04-28-232-33/05 dated 28 December 2005.
Participation of the price of the excessively taken reactive electricity for the distribution systems' users was determined based on the calculation of SERC at the price of 0,00852 KM/kVarh of total excessively taken reactive energy from the transmission network.
Participation of the costs for provision of reserve capacity for the secondary regulation for the distribution systems' users was determined based on the calculation of SERC in the amount of 1.383.516 KM, i.e. 0,000415 KM/kWh of the active electricity taken from the transmission network.
Participation of the prices of transmission losses for distribution systems' users was determined based on the unit prices of electricity generation at the plant outlet in Republic of Srpska, in the amount of 0,001975 KM/kWh of electricity taken from the transmission network. In this calculation, it was used the average weighted prices of electricity at the plant outlet for non-eligible buyers of electricity.
Total costs and prices of the electric power network were allocated on the categories of consumption of the distribution systems' users at the tariff elements which are as follows:
